Welcome to Yoni Nova.
These Terms of Service ("Terms") govern your access to and use of yoninova.com, including all webpages, online stores, products, services, features, content, communications, and transactions operated by or on behalf of Yoni Nova ("Yoni Nova," "we," "us," or "our") (collectively, the "Services").
PLEASE READ THESE TERMS CAREFULLY, PARTICULARLY SECTIONS 21–33 CONCERNING DISPUTE RESOLUTION, INDIVIDUAL ARBITRATION, CLASS-ACTION WAIVER, MASS ARBITRATION, AND YOUR RIGHT TO OPT OUT OF ARBITRATION.
By accessing or using the Services after having an opportunity to review these Terms, or by placing an order, creating an account, subscribing to a product or service, submitting content, or otherwise transacting with Yoni Nova, you agree to be bound by these Terms to the maximum extent permitted by applicable law.
The Terms of Service are available through a clearly identified and conspicuous hyperlink on the Yoni Nova website and are incorporated into each applicable transaction between you and Yoni Nova.
IF YOU DO NOT AGREE TO THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER IN SECTIONS 21–33, DO NOT USE THE SERVICES OR PLACE AN ORDER.
1. Eligibility
You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to purchase products from Yoni Nova.
By using the Services, you represent and warrant that:
• you have legal capacity to enter into this Agreement;
• information you provide is accurate and complete;
• you will comply with these Terms;
• you will comply with applicable laws and regulations; and
• you will use the Services only for lawful purposes.
2. Products
Yoni Nova offers personal-care, cosmetic, feminine-wellness, intimate-care, and related products.
Product descriptions, photographs, ingredients, directions, warnings, educational materials, testimonials, reviews, and other information provided through the Services are for informational and product-use purposes.
You are responsible for reading the actual product packaging, labeling, ingredients, directions, and warnings before using any product.
Product formulations, packaging, ingredients, and labeling may change.
Where online information differs from physical product labeling, the applicable product label controls.
3. No Medical Advice
Information provided through the Services is not medical advice, diagnosis, or treatment.
Yoni Nova does not diagnose medical conditions or provide individualized medical treatment.
Consult an appropriate licensed healthcare professional before using a product if you have a medical condition, allergy, sensitivity, are pregnant or breastfeeding, take medication, have undergone a medical procedure, or otherwise have concerns regarding whether a product is appropriate for you.
If you experience pain, burning, irritation, unusual bleeding, an allergic reaction, or another concerning reaction, discontinue use and seek appropriate medical attention.
4. Individual Results
Individual experiences and results vary.
Testimonials, reviews, photographs, videos, and other customer statements represent individual experiences or opinions and are not guarantees of typical or specific results.
Yoni Nova does not guarantee that any product will produce a particular result.
5. Ingredients and Allergies
Yoni Nova makes reasonable efforts to provide accurate ingredient information.
Formulations may change.
Customers should review the ingredient list appearing on the actual product packaging before use.
Customers are responsible for determining whether a product contains ingredients to which they are allergic or sensitive.
6. Orders
Submitting an order constitutes an offer to purchase the products identified in the order.
Yoni Nova may accept, reject, limit, or cancel orders for lawful reasons, including:
• inventory limitations;
• pricing or technical errors;
• payment problems;
• suspected fraud;
• inaccurate information;
• shipping restrictions;
• unauthorized resale;
• unusual purchasing activity; or
• violation of these Terms.
If Yoni Nova cancels an order after payment has been received, the applicable amount will be refunded to the original payment method, subject to applicable law.
7. Pricing and Taxes
Prices may change without notice.
The price displayed at checkout generally applies to the applicable transaction.
Applicable taxes, shipping charges, customs duties, and other fees may apply.
Yoni Nova may correct obvious pricing or technical errors and cancel affected orders where permitted by law.
8. Shipping
Shipping and delivery estimates are estimates and are not guarantees unless expressly stated otherwise.
Yoni Nova is not responsible for delays caused by carriers, weather, customs, government actions, natural disasters, incorrect addresses, or circumstances outside our reasonable control.
Customers are responsible for providing accurate shipping information.
9. Returns and Refunds
Returns, refunds, cancellations, and exchanges are governed by Yoni Nova's applicable Refund and Return Policy.
Because certain Yoni Nova products are personal-care or intimate-use products, opened or used products may be subject to restrictions.
Nothing in these Terms eliminates any consumer right that cannot legally be waived.
10. Accounts
You are responsible for information associated with your account and for protecting your account credentials.
You must promptly notify Yoni Nova of unauthorized access.
Yoni Nova may suspend or terminate accounts for fraud, abuse, violation of these Terms, or other lawful reasons.
11. Prohibited Conduct
You may not:
• violate applicable law;
• commit fraud;
• interfere with the Services;
• attempt unauthorized access;
• introduce malware or malicious code;
• scrape or harvest information without authorization;
• impersonate Yoni Nova or another person;
• abuse promotions or refund processes;
• submit fraudulent or deceptive reviews;
• infringe intellectual-property rights;
• distribute unlawful content; or
• interfere with the operation or security of the Services.
12. Intellectual Property
Yoni Nova and its licensors own the intellectual property appearing on the Services, including trademarks, logos, product names, photographs, graphics, packaging designs, text, videos, software, product descriptions, website designs, and other proprietary content.
You may not reproduce, modify, distribute, sell, license, publish, or commercially exploit Yoni Nova intellectual property without written authorization.
13. User Content
If you submit reviews, testimonials, photographs, videos, comments, feedback, or other content ("User Content"), you represent that you have the necessary rights to submit it.
You grant Yoni Nova a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and otherwise use User Content in connection with Yoni Nova's business, marketing, advertising, products, and Services.
You remain responsible for your User Content.
Yoni Nova may remove User Content that violates these Terms, applicable law, or legitimate content standards.
14. Reviews and Testimonials
Reviews and testimonials must reflect the submitting person's genuine experience or opinion.
You may not submit fabricated reviews, reviews on behalf of another person without authorization, or content intended to artificially manipulate product ratings.
Yoni Nova may moderate or remove reviews for legitimate reasons, including fraud, unlawful content, privacy violations, intellectual-property violations, or violation of these Terms.
15. Third-Party Services
The Services may incorporate or link to third-party services, including payment processors, shipping providers, analytics providers, advertising platforms, review platforms, social-media services, and other technology providers.
Third-party services may have separate terms and privacy policies.
Yoni Nova is not responsible for third-party services except to the extent required by applicable law.
16. Privacy
Your use of the Services is also governed by the Yoni Nova Privacy Policy.
The Privacy Policy describes how Yoni Nova collects, uses, discloses, retains, and protects personal information and how consumers may exercise applicable privacy rights.
Nothing in these Terms waives or limits a privacy right that cannot legally be waived.
17. Electronic Communications
By using the Services, you consent to receive electronic communications concerning your transactions, orders, accounts, security, customer service, and other matters necessary to provide the Services.
Marketing communications are governed by applicable consent requirements and your communication preferences.
18. Mobile Message Terms
Yoni Nova may offer an SMS/MMS messaging program.
By voluntarily enrolling in Yoni Nova's SMS program, you expressly consent to receive recurring text messages from Yoni Nova at the mobile number provided.
CONSENT TO RECEIVE MARKETING TEXT MESSAGES IS NOT A CONDITION OF PURCHASE.
Message frequency varies. Message and data rates may apply. Your wireless carrier may charge fees for SMS/MMS messages.
Messaging Providers. Yoni Nova sends text messages through third-party messaging providers, which may include Klaviyo and Shopify. Messages may be sent from a Yoni Nova messaging number, a short code, or a messaging number assigned by the applicable provider, and Yoni Nova may use additional or different numbers, short codes, or messaging infrastructure as the SMS program develops.
Opt Out. You may opt out of marketing messages at any time by replying STOP to any Yoni Nova text message, or by using the unsubscribe link where provided. Your STOP or opt-out request is processed by the messaging platform that sent the message. After opting out, you may receive one confirmation message. If you are enrolled in more than one Yoni Nova messaging program, you may need to opt out of each separately as indicated in the applicable messages.
Help. For assistance, reply HELP to any Yoni Nova text message or contact Yoni Nova through the customer-service information provided on yoninova.com.
Carrier Disclaimer. Wireless carriers are not liable for delayed or undelivered messages. Yoni Nova is not responsible for carrier network failures, coverage limitations, filtering, or other carrier-controlled conditions.
SMS information is governed by the Yoni Nova Privacy Policy. Messages sent through a third-party messaging provider are also subject to that provider's applicable terms.
19. Consent and Privacy Choices
Yoni Nova uses a consent-management system designed to provide visitors with choices concerning non-essential cookies, pixels, tags, advertising technologies, analytics technologies, and similar tracking technologies.
Where consent is required, applicable non-essential tracking technologies are designed to remain disabled until the required consent is provided.
Visitors may decline or manage non-essential tracking through the privacy controls provided by Yoni Nova.
Yoni Nova also processes qualifying opt-out preference signals, including Global Privacy Control ("GPC"), as described in the Privacy Policy.
Privacy choices do not waive statutory privacy rights.
20. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
YONI NOVA DISCLAIMS WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
YONI NOVA DOES NOT GUARANTEE THAT:
• the Services will always be available;
• the Services will be error-free;
• information will always be current;
• products will produce particular results; or
• the Services will always be uninterrupted or completely secure.
Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
AI-Assisted Content
Certain content on the Services, including product descriptions, blog posts, and marketing materials, may be generated, edited, or optimized using artificial intelligence (AI) tools. While Yoni Nova makes reasonable efforts to ensure the accuracy and quality of this information, AI-assisted content may occasionally contain errors or inaccuracies, and Yoni Nova is not liable for incidental discrepancies arising from AI-assisted text. Product claims and product specifications are reviewed and verified by Yoni Nova prior to publication. The Services do not use AI to interact with customers, and AI is not used to generate product claims.
IMPORTANT — ARBITRATION AND CLASS-ACTION WAIVER
THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER.
UNLESS YOU VALIDLY OPT OUT WITHIN 30 DAYS AS PROVIDED IN SECTION 31, YOU AND YONI NOVA AGREE TO RESOLVE COVERED DISPUTES THROUGH INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDINGS TO THE MAXIMUM EXTENT PERMITTED BY LAW.
PLEASE READ SECTIONS 21–33 CAREFULLY BEFORE USING THE SERVICES OR PLACING AN ORDER.
21. Important Dispute-Resolution Notice
PLEASE READ THIS SECTION CAREFULLY.
Except for matters expressly excluded below, you and Yoni Nova agree that disputes will be resolved through individual binding arbitration rather than court litigation.
This means that, subject to applicable law and the exceptions below, you and Yoni Nova waive the right to have covered disputes decided by a judge or jury.
22. Informal Dispute Resolution
Before commencing arbitration, the party asserting a dispute must first provide written notice describing:
• the nature of the dispute;
• the facts supporting the claim;
• the relief requested; and
• sufficient contact information to communicate concerning the dispute.
The parties will attempt in good faith to resolve the dispute for thirty (30) days following receipt of the notice.
Nothing in this section prevents a party from seeking temporary or emergency equitable relief where legally available.
23. Binding Individual Arbitration
Except for claims that qualify for small-claims court and claims that cannot legally be arbitrated, you and Yoni Nova agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, products purchased from Yoni Nova, communications, advertising, privacy practices, transactions, or the relationship between you and Yoni Nova shall be resolved by binding arbitration on an individual basis.
This agreement applies to claims based on:
• contract;
• tort;
• negligence;
• statute;
• regulation;
• consumer-protection law;
• privacy law;
• advertising law; or
• any other legal theory.
The arbitration will be administered by the American Arbitration Association (“AAA”) under the applicable AAA Consumer Arbitration Rules and Mediation Procedures and, when applicable, the AAA Mass Arbitration Supplementary Rules.
The then-current AAA rules and applicable fee schedules are incorporated into this Agreement to the extent applicable.
The arbitrator will generally determine questions concerning the interpretation, applicability, enforceability, or formation of this arbitration agreement, except where applicable law requires a court to determine a particular issue.
24. Class, Collective, Consolidated, and Representative Action Waiver
YOU AND YONI NOVA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY.
To the maximum extent permitted by law:
• you may not participate in a class action against Yoni Nova;
• you may not bring a claim on behalf of other consumers;
• you may not act as a class representative;
• you may not participate in a collective action;
• you may not pursue representative relief on behalf of other persons;
• claims of multiple persons may not be consolidated except as permitted by this Agreement and applicable AAA rules; and
• the arbitrator may not conduct a class, collective, or representative proceeding unless applicable law prohibits enforcement of the waiver.
Each party may seek relief only for its own individual claim.
25. Mass Arbitration
If substantially similar individual arbitration demands are filed against Yoni Nova by or through the same, coordinated, or affiliated counsel in sufficient numbers to qualify as a mass arbitration under applicable AAA rules, the proceedings will be administered under the AAA Mass Arbitration Supplementary Rules, to the extent those rules apply.
The parties acknowledge that mass filings may require procedures different from ordinary individual arbitration.
26. Batching and Bellwether Procedure
To the maximum extent permitted by applicable law and the applicable AAA rules, substantially similar arbitration claims may be organized and administered in batches.
The parties agree to cooperate with AAA concerning an orderly process for:
• grouping substantially similar claims;
• selecting an initial group of representative cases;
• resolving common procedural issues;
• conducting mediation where appropriate;
• evaluating settlement; and
• proceeding with subsequent batches.
The initial representative cases may be referred to as "bellwether" cases.
If the parties cannot agree on the initial bellwether cases, the selection may be made through a neutral process permitted by AAA.
27. Effect of Bellwether Cases
A bellwether arbitration award is binding only on the parties to that arbitration unless otherwise agreed in writing or required by applicable law.
Bellwether proceedings may be used to evaluate recurring factual, legal, procedural, or damages issues and to facilitate resolution of substantially similar remaining claims.
Nothing in this section authorizes an arbitrator to bind a person who is not a party to the arbitration.
28. Staged Arbitration
Following completion of the initial bellwether proceedings, remaining substantially similar claims may proceed in successive batches consistent with applicable AAA rules and applicable law.
The parties may request that AAA establish reasonable procedures for scheduling, mediation, briefing, hearings, and administration of subsequent batches.
Nothing in this section eliminates an individual's right to pursue a valid individual claim.
29. Arbitration Fees
The parties' respective responsibilities for arbitration filing, administrative, and arbitrator fees will be governed by applicable law and the applicable AAA consumer and mass-arbitration rules.
Nothing in this Agreement requires a consumer to pay an arbitration fee that applicable law or AAA consumer rules require Yoni Nova to pay.
Yoni Nova reserves all rights concerning fraudulent, duplicative, improperly filed, or procedurally defective claims.
30. Small-Claims Exception
Nothing in these Terms prevents either party from bringing an individual qualifying claim in small-claims court.
A small-claims proceeding must remain an individual proceeding and may not be converted into a class, collective, consolidated, or representative proceeding except where required by law.
31. Arbitration Opt-Out
YOU MAY OPT OUT OF THE ARBITRATION AGREEMENT.
To opt out, you must send written notice to Yoni Nova within thirty (30) days after the date you first accept these Terms.
Your notice must:
• identify you;
• provide sufficient information to identify the applicable account or transaction;
• clearly state that you are opting out of the arbitration agreement; and
• be sent to the legal-notice address or email identified in Section 38.
A valid opt-out applies only to the person submitting it.
Opting out of arbitration does not affect the remaining provisions of these Terms.
32. Arbitration Location and Hearings
Arbitration may be conducted remotely unless an in-person proceeding is required or otherwise appropriate.
If an in-person hearing is required, the parties agree that the hearing should, to the extent permitted by applicable law and AAA rules, occur in Henry County, Georgia, or another location reasonably convenient to the consumer as required by applicable consumer-arbitration rules.
The arbitration will be conducted by a neutral arbitrator.
The arbitrator may award individualized monetary or equitable relief available under applicable law.
33. Governing Law
These Terms and disputes arising from them are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except to the extent federal law or mandatory consumer-protection law requires otherwise.
The Federal Arbitration Act, 9 U.S.C. §§ 1–16, governs the interpretation and enforcement of the arbitration agreement to the maximum extent applicable.
Nothing in this section deprives a consumer of a non-waivable right under the laws of the consumer's state of residence.
For court proceedings permitted under these Terms, including proceedings concerning arbitration or emergency equitable relief, the parties consent to jurisdiction in the state and federal courts located in Georgia, subject to mandatory jurisdictional rights.
34. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YONI NOVA AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YONI NOVA'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES, ANY PRODUCT, ANY PARTICULAR TRANSACTION, OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
(A) the amount you paid Yoni Nova for the product or service giving rise to the claim during the six (6) months preceding the event giving rise to the claim; or
(B) $100.
Nothing in these Terms limits liability that cannot legally be limited.
35. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Yoni Nova and its owners, officers, directors, employees, agents, affiliates, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from:
• your violation of these Terms;
• your unlawful use of the Services;
• your User Content;
• your violation of another person's rights; or
• your unauthorized use of the Services.
36. Termination
Yoni Nova may suspend or terminate access to the Services where permitted by law.
Termination does not eliminate provisions that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, arbitration, and class-action provisions.
37. Changes to These Terms
Yoni Nova may modify these Terms periodically.
The current version will be posted on yoninova.com with a revised "Last Updated" date.
Where legally required, Yoni Nova will provide additional notice of material changes.

Legal notices concerning disputes, arbitration, or an arbitration opt-out should identify the sender, provide sufficient contact information, identify the transaction or account when applicable, and clearly state the purpose of the notice.
39. Severability
If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain effective.
If any portion of the arbitration or class-action provisions is unenforceable, it will be limited only to the extent necessary.
40. No Waiver
Yoni Nova's failure to enforce any provision of these Terms does not constitute a waiver of that provision.
41. Entire Agreement
These Terms, the Yoni Nova Privacy Policy, Refund and Return Policy, Shipping Policy, Mobile Message Terms, and other policies expressly incorporated into these Terms constitute the agreement between you and Yoni Nova concerning the Services.
42. Acknowledgment and Assent
BY ACCESSING OR USING THE SERVICES, PLACING AN ORDER, CREATING AN ACCOUNT, SUBMITTING CONTENT, SUBSCRIBING TO A PRODUCT OR SERVICE, OR OTHERWISE TRANSACTING WITH YONI NOVA AFTER HAVING AN OPPORTUNITY TO REVIEW THESE TERMS, YOU AGREE TO BE BOUND BY THESE TERMS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE INDIVIDUAL ARBITRATION AGREEMENT, CLASS-ACTION WAIVER, AND MASS-ARBITRATION PROVISIONS CONTAINED IN SECTIONS 21–33.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SERVICES OR PLACE AN ORDER.
